As a builder, most states require you to offer at least a 1-year warranty to your customer, or, if it is a spec, to your buyer. This is a great warranty, that covers all of a customer’s concerns, and one that isn’t too technical that you wouldn’t be able to adequately service the warranty. By including this warranty with your buyer or customer documents, it gives you the document you need, as well as credibility.
We have spent years building a warranty that is reasonable for both sides and allows buyers to feel good about you as the renovator/rehabber, and for you as the renovator/rehabber to feel good about your product, while at the same time not giving the impression that you are a landlord to your buyers as well. Check your state laws to confirm the timing of when you are required to deliver at least a sample copy of the builders’ warranty to buyers. In many states, it is before mutual acceptance of any purchase/sale, so you include a sample copy at the minimum in your sales paperwork. You can then hand-deliver a copy of that same warranty to the buyer at closing, or during your walk-through or new buyer orientation. This warranty can be delivered to a buyer upon mutual acceptance of a purchase and sale contract, or, can be used to market the property, and attached to the purchase and sale contract.
